1031 Exchange — Tax-Deferred Property Swap

A 1031 Exchange (named after Section 1031 of the IRS Code) allows real estate investors to defer paying capital gains taxes when they sell an investment property — as long as they reinvest the proceeds into a "like-kind" property. This is one of the most powerful wealth-building tools in real estate.

How It Works

  1. Sell your current investment property
  2. Identify replacement property within 45 days
  3. Close on replacement property within 180 days
  4. Use a Qualified Intermediary (QI) to hold funds
  5. Capital gains taxes are deferred — not eliminated

Key Rules

  • Must be investment or business property (not primary residence)
  • Like-kind: any real estate for any real estate
  • Replacement property must be equal or greater value
  • All cash proceeds must be reinvested
  • Cannot touch the funds — must use a Qualified Intermediary
  • Can do multiple exchanges to defer taxes indefinitely
